Fiduciary Services 

I offer fiduciary services either through direct appointment or by assisting those who are appointed.

What is a fiduciary? In a general sense, a fiduciary is someone who acts on behalf of another person, putting that person’s interests ahead of their own, with a duty to act in good faith and trust. In a legal context, fiduciaries are appointed by courts or through a legal document (such as a power of attorney, trust agreement, or will) to act on behalf of another person. Legally appointed financial fiduciaries are known by various titles such as conservator, representative payee (Social Security) or VA-Appointed Fiduciary (Veterans Administration).

What does a financial fiduciary do? Responsibilities vary depending on the specific appointment, for example:

  • Maintain accurate and detailed records of all financial transactions.

  • Provide regular reports to the court, the Social Security Administration (for representative payees), or other relevant bodies, as required.

  • Collect, manage, and protect the individual's income and assets.

  • Invest assets prudently and in accordance with any legal or regulatory guidelines.

  • Ensure that bills are paid on time and that the individual’s needs are met.

  • Use the individual’s funds to pay for their living expenses, medical care, and other necessary expenditures.

  • Ensure that surplus funds are saved or invested appropriately.

  • Keep the individual's financial information private and only share it as necessary to fulfill fiduciary duties.

  • Keep the individual’s funds separate from the fiduciary’s own funds.

  • As needed, obtain guidance from financial advisors, attorneys, or other professionals to ensure the best decisions are made on behalf of the individual.
